Report Misleading Financial Adverts
Financial advertising and promotions should be fair, clear and not misleading. If you consider that an advert/financial promotion is misleading or not clear do contact the MFSA.
Unauthorised Payments
Money can only be taken from your account if you have authorised the transaction. If you notice a payment out of your account which you did not authorise, you should contact your Bank immediately and claim a refund.
In most cases the Bank must refund the payment without undue delay and by the end of the business day following the day on which it became aware of the problem, unless it has reasonable grounds for suspecting that you have acted fraudulently.
Your bank can refuse a refund for an unauthorised payment if:
- it can prove you had actually authorised the transaction. However, your bank cannot simply say that use of your password, card or PIN conclusively proves you authorised a payment;
- it can prove you are at fault because you acted fraudulently or because you deliberately, or with ‘gross negligence’, failed to protect the details of your card, PIN or password in a way that allowed the transaction;
- you told your bank about an unauthorised payment 13 months or more after the date it left your account.

When advertising their products, financial services providers should clearly explain what the product or service is, how it works and how you could benefit from it. They must also be clear about the costs involved and whether there are any risks to your money.
Financial adverts and promotions can be misleading for many reasons, but there are some questions you can consider to help you spot misleading financial adverts, such as:
- Do I understand what is the product or service being presented?
- Does the promotion make it clear who I am are dealing with and/or who will be providing the product/service?
- Do I have to pay any fee for that product or service or related to that?
- Are the interest rates or returns realistic?
- What are the risks for my money and is this clear?
- How long do I have to commit for?
- Are there any penalties if I want to move my money?
- Is the product guaranteed?
