Overview
As part of its main functions, the Malta Financial Services Authority (the “MFSA” or “the Authority”) oversees the protection of consumers and the supervision of all financial services activities and license holders which have an ongoing duty of acting honestly, professionally and in accordance with the best interest of the client. In this respect, currently there is only the MFSA Conduct of Business Rulebook which is applicable to insurance undertakings and distributors, and investment firms including credit institutions which are licensed to provide investment services.
The purpose of this Consultation Document is to obtain the industry’s views on the draft chapters of the Conduct of Business Rulebook for Credit Institutions offering retail products to clients in Malta. The five chapters of this new Conduct of Business Rulebook for Credit Institutions relate to the following topics, respectively: (1) Disclosures; (2) Marketing Rules; (3) Product Oversight Requirements; (4) Conflicts of Interest; and (5) Bank-Client Relationships.
It is the MFSA’s intention to have a single Conduct of Business Rulebook which will be applicable to Credit Institutions offering retail products to clients in Malta as defined in the subsequent ‘Applicability’ section of this Consultation Document. The entities shall be generally referred to as ‘Regulated Persons’ with some specific instances differentiating between manufacturers and distributors.

Sarah Pulis
Sarah Pulis holds the position of Head within the Conduct Supervision function at the MFSA. Sarah has twenty years of experience in the regulation and supervision of financial services, namely investment firms, collective investment schemes, company services providers, insurance undertakings and insurance intermediaries. During her career, she has represented the Authority on various committees with ESMA and EIOPA. Sarah read law at the University of Malta and graduated as a Notary Public and Doctor of Laws in 1996 and 1999 respectively. She also obtained a Master of Laws in European Union Law from the University of Leicester in 2006.

Patrick Bartolo
Patrick Bartolo joined the MFSA in August 2023 as a Deputy Head in the Banking Team within Conduct Supervision. He has a 22 years of experience within the local Banking Industry. He primarily worked within the Investment and Retail Banking areas and his main specialisation related to Credit Analysis and Customer Relationship Management. Patrick graduated from the University of Malta in 2002 and also achieved qualifications related to AML in 2023 through ACAMS.

Ruth Grioli
Ruth Grioli commenced her career over 30 years ago at the Central Bank of Malta’s Banking Supervision Function before moving to the MFSA's Banking Supervision Function in 2002, following the transfer of remit. Throughout these years Ruth was involved in many on-site inspections and thematic reviews, covering various risks. In December 2022, Ruth has been appointed as a Senior Manager in the Banking Team within Conduct Supervision. She participated in various meetings at international fora, including those organised by the ECB and the EBA.

Abigail Attard
Abigail Attard is a warranted lawyer who joined the MFSA in 2014 and currently holds the position of Senior Technical Expert within the MFSA Conduct Supervision Function. Abigail is an experienced lawyer skilled in financial services and consumer protection law. She is in possession of a Doctor of Laws (L.L.D) from the University of Malta and was awarded a Masters of Laws (L.L.M) in Financial Services Law from the University of London in 2017.

Donna M Galea Ellul
Donna Galea Ellul joined the Malta Financial Services Authority in 2015. After graduating in Banking and Finance, she spent five years working within the banking industry and after that she moved to the Banking Supervision Unit of the Authority. She has been occupying the role of Senior Analyst in the Banking Team within the Conduct Supervision Unit since September 2022.

Jasmine Azzopardi
Jasmine Azzopardi joined the Malta Financial Services Authority in 2024. After graduating in Banking and Finance, she spent two and a half years working within the banking industry. She has been occupying the role of Analyst in the Banking Team within the Conduct Supervision Unit since January 2024.

Maria Cassar
Maria Cassar has joined the MFSA in 2019 as an intern and worked on several internal projects. She has moved to Conduct Supervision in July 2022 and since then had worked on various thematic reviews and onsite inspections. Maria has just obtained her Master of Science in Finance (Banking).
